La mandataria anunció que denunciará a la jueza que emitió la orden de suspensión contra la Reforma al Poder Judicial
CDMX.- La Asociación Nacional de Magistrados de Circuito Jueces de Distrito del Poder Judicial de la Federación (JUFED) manifestó que «se ha roto el orden constitucional y el Estado de derecho», luego de que la presidenta Claudia Sheinbaum se negó a cumplir una orden judicial para bajar del Diario Oficial de la Federación la Reforma al Poder Judicial.
La mandataria dijo ayer que la jueza que emitió la orden judicial se extralimita en sus funciones y que “no tiene ninguna atribución” , por lo que lejos de acatar el mandato del Poder Judicial, la funcionaria anunció la presentación de una denuncia contra la jueza Nancy Juárez ante el Consejo de la Judicatura Federal (CJF).
El juzgado 19 de distrito con sede en Coatzacoalcos, Veracruz, otorgó una suspensión definitiva en la que ordena a la Presidenta de la República Claudia Sheinbaum y al director del Diario Oficial de la Federación, Alejandro López González a que dentro en un plazo de 24 horas, contadas a partir de que le sea notificada la resolución, informen y acrediten que se ha eliminado del Diario oficial de la Federaciön (DOF) la publicación del decreto que valida la reforma judicial. En las resoluciones del juicio de amparo 823/2024, se señala que en caso de desacato a esta decisión, “se dará vista al Ministerio Público de la Federación por el delito que establece la fracción III del artículo 262 de la Ley de Amparo”.
Artículo 262
Se impondrá pena de tres a nueve años de prisión, multa de cincuenta a quinientos días, destitución e inhabilitación de tres a nueve años para desempeñar otro cargo, empleo o comisión públicos, al servidor público que con el carácter de autoridad responsable en el juicio de amparo o en el incidente de suspensión… que (III.) No obedezca un auto de suspensión debidamente notificado, independientemente de cualquier otro delito en que incurra.
Por su parte, la JUFED informó en un comunicado que en cualquier país democrático y que salvaguarda el Estado de derecho, las objeciones a la decisiones judiciales, «se controvierten agotando los medios de impugnación y no mediante amenazas contra el emisor».
La asociación encabezada por la jueza Juana Fuentes Velázquez le recordó a Sheinbaum que la JUFED apoya a la jueza de distrito del juzgado 19 Nancy Juárez, quien tiene todo el apoyo de la Directiva Nacional y de todos sus compañeros juzgadores federales.
