- Mueren 25 mil personas anualmente por causas derivadas de la mala calidad del aire, por lo que la CNDH reconoció que la contaminación urbana representa una violación a los derechos humanos, a la salud y al ambiente sano.
Para respetar y garantizar los derechos humanos de la población en México, las autoridades de todos los órdenes de gobierno deben modificar la política pública en materia de contaminación atmosférica urbana, cumpliendo cabalmente con las recomendaciones que la CNDH les realiza. Las organizaciones de la sociedad civil que impulsaron esta Recomendación reiteraron la urgencia de:
- Armonizar el marco normativo en materia ambiental, de salud y energético con las obligaciones generales en materia de derechos humanos.
- Revisar y actualizar todas las NOM relevantes a la calidad del aire de manera acorde con los límites máximos recomendados por la OMS.
- Generar una estrategia de comunicación que brinde información en materia de contaminación atmosférica urbana, y los daños a la salud y medio ambiente que se ocasionen en cada estado.
- Implementar mecanismos para cumplir con las especificaciones de los combustibles fósiles que se producen y/o distribuyen en el país de acuerdo con las NOM respectivas y realizar las visitas de inspección necesarias para verificar que las especificaciones de las gasolinas y diésel en todo el territorio nacional cumplan con las especificaciones.
- Realizar los estudios e investigaciones indispensables para la emisión de una NOM que regule los límites máximos de emisión sobre compuestos orgánicos volátiles.
- Desarrollar e implementar políticas públicas a nivel nacional para una movilidad sustentable, incluyendo la promoción efectiva de la movilidad activa y segura, así como programas de implementación y/o coordinación con gobiernos estatales y municipales para que se pongan en circulación un mayor número de unidades de transporte público urbano de cero emisiones a nivel nacional.
- Instalar y fortalecer estaciones de monitoreo de calidad del aire en todas las ciudades detectadas con problemática de contaminación atmosférica urbana; y estandarizar la eficiencia en la medición que se realiza por los distintos sistemas de monitoreo existentes, de manera que su información sea confiable y comunicada en tiempo real.
